1. Introduction

Fairview Commercial Lending, Inc. (“Fairview,” “we,” “our,” or “us”), operating the Georgia Hard Money lending website at georgiahardmoney.com (the “Site”), is committed to protecting the privacy of visitors to our Site. This Privacy Policy explains what information we collect, how we use it, with whom we share it, and your choices regarding that information.

By accessing or using our Site, you agree to the terms of this Privacy Policy. If you do not agree, please discontinue use of the Site. A cookie consent notice is displayed on our Site; by clicking “Ok” or continuing to browse, you consent to our use of cookies as described herein.

2. About Georgia Hard Money / Fairview Commercial Lending

Fairview Commercial Lending is a privately funded hard money lender headquartered in Atlanta, Georgia, with over 100 years of combined Georgia commercial real estate lending experience. The firm has been lending since 1975 and provides hard money loans, bridge loans, and private money loans on residential investment, commercial, and agricultural properties throughout the state of Georgia. Loan transactions are underwritten and funded entirely in-house from Fairview’s own capital.

3. Information We Collect

3.1 Information You Provide Directly

  • Contact / Ask Us A Question form (name, email address, subject, and message)
  • Loan application forms (accessed via fairviewlending.com — name, property details, financial information, loan purpose)
  • PDF download requests (Hard Money Guide download)

3.2 Information Collected Automatically

When you visit our Site, certain information is collected automatically through cookies and tracking technologies (described in Section 4), including:

  • IP address and approximate geographic location
  • Browser type, version, and language
  • Operating system and device type
  • Pages visited, time on page, scroll depth, and navigation paths
  • Referring URL (website that directed you to ours)
  • Clicks on links, buttons, and calls-to-action
  • Video interaction data (play, pause, completion of embedded videos)

4. Tracking Technologies Used on This Site

The following specific tracking technologies have been identified on georgiahardmoney.com based on its infrastructure and third-party integrations:

4.1 Google Tag Manager

Technology: Google Tag Manager

Third Party: Google LLC

Purpose: Tag deployment and management platform

Google Tag Manager (GTM) is confirmed present on every page of this Site via a noscript iFrame and JavaScript snippet referencing container ID GTM. GTM is a tag management system that loads and fires other tracking scripts — including Google Analytics, the Facebook Pixel, the LinkedIn Insight Tag, and any other marketing or analytics tags — without requiring direct code changes to the website. The tags currently deployed within this GTM container control what other third-party tracking is active on the Site. GTM itself sets the following cookies:

  • _dc_gtm_UA-* or _dc_gtm_G-* — Used to throttle request rate for Google Analytics tags fired through GTM; expires after 1 minute

4.2 Google Analytics (via GTM)

Technology: Google Analytics 4 (GA4), loaded via Google Tag Manager

Third Party: Google LLC

Purpose: Website analytics, traffic measurement, and user behavior analysis

Google Analytics is deployed through GTM container GTM-WN65VHK to measure how visitors find and use our Site, including traffic sources, popular pages, loan application funnel performance, and newsletter signup conversions. Google’s privacy policy is available at policies.google.com/privacy. Typical cookies include:

  • _ga — Distinguishes unique users; expires after 2 years
  • _ga_[ID] — Persists GA4 session state; expires after 2 years
  • _gid — Distinguishes users over a short window; expires after 24 hours
  • _gat_gtag_UA-* — Throttles analytics request rate; expires after 1 minute

4.3 Facebook / Meta Pixel (via GTM)

Technology: Facebook Pixel, deployed via GTM (associated with facebook.com/coloradohardmoney integration)

Third Party: Meta Platforms, Inc.

Purpose: Advertising measurement, retargeting, and conversion tracking

The Site actively integrates with the Fairview Facebook business page (facebook.com/coloradohardmoney). The Facebook Pixel, deployed via GTM, tracks visitor activity to measure the effectiveness of Facebook and Instagram advertising campaigns and enables retargeting of previous Site visitors with relevant ads. Meta’s data policy is available at facebook.com/privacy/policy. Typical cookies include:

  • _fbp — Identifies browsers for ad delivery and measurement; expires after 90 days
  • _fbc — Stores Facebook click IDs from paid ad referrals; expires after 90 days

4.4 LinkedIn Insight Tag (via GTM)

Technology: LinkedIn Insight Tag, deployed via GTM (associated with linkedin.com/company/fairview-lending integration)

Third Party: LinkedIn Corporation (Microsoft)

Purpose: Professional audience analytics, ad conversion tracking, and retargeting

The Site actively links to Fairview’s LinkedIn company page. The LinkedIn Insight Tag, deployed via GTM, enables conversion tracking, audience demographic insights, and retargeting of real estate and finance professionals through LinkedIn advertising campaigns. LinkedIn’s privacy policy is available at linkedin.com/legal/privacy-policy. Typical cookies include:

  • li_fat_id — Member indirect identifier for LinkedIn ad attribution
  • bcookie — Browser identifier; expires after 2 years
  • lidc — Facilitates data center selection; expires after 24 hours
  • UserMatchHistory — LinkedIn ad matching; expires after 30 days

4.5 WordPress / Divi Platform Cookies

Technology: WordPress CMS with Divi Theme

Purpose: Core website functionality and page builder operation

WordPress and the Divi page builder set functional cookies necessary for the Site to operate correctly. These are not used for tracking or advertising. Typical cookies include:

  • wordpress_test_cookie — Verifies browser cookie support
  • wp-settings-[user_id] — Stores WordPress interface preferences (administrator use only)
  • wordpress_logged_in_[hash] — Tracks administrator login state; not set for general visitors
  • et_pb_ab_view_page_[post_id] — Set by Divi’s A/B testing module for page layout optimization

4.6 Cookie Consent Plugin

Technology: Cookie consent/notice banner (displayed site-wide)

Purpose: Obtaining and recording visitor cookie consent

A cookie consent notice reading “We use cookies to ensure that we give you the best experience on our website” is displayed on every page. Clicking “Ok” sets a cookie to record your consent and suppress the notice on future visits. Typical cookie:

  • cookielawinfo-checkbox-* or viewed_cookie_policy — Records acknowledged consent; typically expires after 1 year

4.7 Twitter / X Card Meta Tags

Technology: Twitter Card meta tags (twitter:card = summary_large_image on all pages)

Third Party: X Corp. (formerly Twitter, Inc.)

Purpose: Social sharing preview formatting on X/Twitter

Every page includes Twitter Card meta tags (twitter:card set to summary_large_image) that control how our pages appear when shared on X. These tags do not place cookies directly on your device but transmit metadata to X’s servers when a link is shared or previewed on that platform.

4.8 Open Graph / Facebook Meta Tags

Technology: Open Graph protocol meta tags (og: tags on all pages)

Purpose: Rich preview formatting when pages are shared on social platforms

Open Graph tags (og:title, og:description, og:image, og:url, og:type) are present on all pages. These control how our content appears when shared on Facebook, LinkedIn, and other platforms that support the Open Graph standard. The tags themselves do not set cookies but enable those platforms to render rich link previews.

4.9 Third-Party Video Content

Technology: MP4 video hosted on coloradohardmoney.com CDN

Purpose: Promotional video content about Fairview’s lending services

The homepage features a background video served from coloradohardmoney.com (a sister Fairview brand domain). When the video loads, your browser makes a request to that domain’s servers. No third-party video platform (YouTube, Vimeo) is involved, so no external advertising cookies are set by the video player.

4.10 Google Maps Links

Technology: Google Maps hyperlinks (address links on Contact and footer)

Third Party: Google LLC

Purpose: Office location navigation

Our address links (3535 Roswell Road Ste 57, Marietta, GA 30062) point to Google Maps. These are standard hyperlinks — no iFrame is embedded — so Google only receives data if and when you click the link and navigate to Google Maps.

4.11 Google Reviews Link

Technology: Google Search / Google Business Profile review link

Third Party: Google LLC

The Site footer links to Fairview’s Google Business Profile reviews page (Google Search for Fairview Commercial Lending, ludocid=17385359874239970825). This is an outbound link only; no Google Review widget is embedded on the page, so no additional tracking occurs unless you click the link.

4.12 Newsletter / Email Marketing Service

Technology: Email list management service (two newsletter signup forms on homepage)

Purpose: Delivering weekly Georgia real estate and finance newsletter to opt-in subscribers

Two newsletter signup forms on the homepage collect your name and email address to subscribe to our weekly newsletter for Georgia real estate and finance professionals (25,000+ subscribers). Subscription data is processed through a third-party email service provider. Every newsletter email includes an unsubscribe link.

5. How We Use Your Information

We use collected information to:

  • Evaluate and respond to hard money loan inquiries and applications
  • Deliver the weekly Georgia real estate and finance newsletter to opt-in subscribers
  • Respond to questions submitted through the contact form
  • Measure and optimize the performance of our advertising campaigns (via GTM, Google Analytics, Facebook Pixel, LinkedIn Insight Tag)
  • Analyze website traffic and user behavior to improve Site content and conversion rates
  • Fulfill PDF download requests (Hard Money Guide)
  • Comply with applicable legal, regulatory, and licensing requirements
  • Protect the security and integrity of our Site and business operations

6. How We Share Your Information

We do not sell your personal information to third parties. We may share information in the following limited circumstances:

  • Advertising Platforms: Aggregated or pseudonymous data is shared with Google, Meta, and LinkedIn as part of advertising campaign measurement and optimization. This data is subject to each platform’s own privacy policies.
  • Email Service Provider: Newsletter subscriber data (name and email) is processed by our third-party email platform to deliver newsletters.
  • Service Providers: Trusted vendors who assist with website hosting, analytics, and communications, bound by confidentiality obligations.
  • Legal Requirements: When required by law, subpoena, court order, or government authority.
  • Business Transfers: In connection with a merger, acquisition, or sale of assets, with appropriate confidentiality protections.
  • Internal Funding & Risk Management: To the extent permissible by law, for internal lending considerations and risk management, only with organizations that meet our privacy standards.

7. Financial Privacy Practices

As a privately funded hard money lender, we are committed to the following financial privacy practices:

  • We collect customer information only to the extent needed to evaluate and fund loan transactions.
  • We protect your information from unauthorized access using established security standards.
  • We actively seek to verify your identity before assisting you.
  • We do not share or sell customer information to parties who wish to market their products or services to you.
  • We take all reasonable steps to dispose of personal information in a manner that prevents unauthorized access.
  • Any organization providing services to our company is required to meet our privacy standards.

8. Your Privacy Choices

8.1 Cookie Management

Most web browsers allow you to manage cookie preferences in their settings. Disabling cookies may affect Site functionality, including forms. Browser-specific instructions:

  • Chrome: Settings > Privacy and security > Cookies and other site data
  • Firefox: Settings > Privacy & Security > Cookies and Site Data
  • Safari: Preferences > Privacy > Manage Website Data
  • Edge: Settings > Cookies and site permissions

8.2 Google Analytics Opt-Out

You may opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on at tools.google.com/dlpage/gaoptout.

8.3 Facebook Ad Preferences

You can manage your Facebook ad preferences, including opting out of interest-based advertising, at facebook.com/ads/preferences.

8.4 LinkedIn Ad Opt-Out

You can opt out of LinkedIn retargeting by visiting linkedin.com/psettings/guest-controls/retargeting-opt-out.

8.5 Google Tag Manager

Because GTM controls the deployment of multiple tracking technologies, opting out of individual platforms (Google Analytics, Facebook, LinkedIn) via the methods above is the most effective way to limit data collection. You may also use browser extensions such as uBlock Origin or Privacy Badger to block GTM container scripts.

8.6 Newsletter Unsubscribe

You may unsubscribe from our newsletter at any time by clicking the unsubscribe link included in every newsletter email, or by contacting us directly using the information in Section 13.

8.7 Do Not Track

Our Site does not currently respond to “Do Not Track” browser signals. We will update this policy if our practices change.

9. Data Security

We implement commercially reasonable administrative, technical, and physical safeguards to protect your personal information, including secure HTTPS transmission across all pages of the Site, access controls, and data minimization practices.

No method of data transmission over the internet is 100% secure. If you have concerns about the security of information you have provided, please contact us immediately using the details in Section 13.

10. Children’s Privacy

Our Site is directed exclusively at real estate investors, borrowers, and finance professionals. We do not knowingly collect personal information from individuals under the age of 18. If you believe we have inadvertently collected information from a minor, please contact us and we will promptly delete it.

11. Third-Party Links and Sister Sites

Our Site contains links to third-party and affiliated websites, including fairviewlending.com (our main site), coloradohardmoney.com (our Colorado brand), georgiahardmon.wpengine.com (staging environment), as well as external lender resources. This Privacy Policy applies only to georgiahardmoney.com. We encourage you to review the privacy policies of any third-party or affiliated sites you visit.

12.1 Georgia Residents

Georgia residents may contact us to request information about the personal data we hold, to request corrections, or to request deletion of their information where no legal or regulatory retention requirement applies.

12.2 California Residents (CCPA / CPRA)

To exercise any such rights, please contact us using the information in Section 13.

13. Changes to This Privacy Policy
